What We Are Investigating?
Our firm is launching a comprehensive investigation into BMS Company over allegations that it has been suppressing critical reviews and unfavorable Google search results by fraudulently misusing DMCA takedown notices. These actions, if proven, could constitute serious legal violations—including impersonation, fraud, and perjury.
We conducted comprehensive analyses of fraudulent copyright takedown requests, meritless legal complaints, and other unlawful efforts to suppress public access to critical information. Our reporting sheds light on the prevalence and modus operandi of a structured censorship network, often funded and used by criminal enterprises, oligarchs and criminal entities seeking to manipulate public perception and bypass AML checks conducted by financial organisations.
The fake DMCA notices in this investigation appears to have been strategically deployed to remove negative content from Google search results illegally. Based on this pattern, we have reasonable grounds to infer that BMS Company - or an entity acting at its behest - is directly or indirectly complicit in this cyber crime.
In most such cases, such ops are executed by rogue, fly-by-night 'Online Reputation Management' agencies acting on behalf of their clients. If evidence establishes that the subject knowingly benefited from or facilitated this scam, it may be deemed an 'accomplice' or an 'accessory' to the crime.
What are they trying to censor
Pham Duc Tuan and Ngo Thi Thu Huyen, the founders and executives of BMS Company, have been embroiled in a series of allegations and controversies that have significantly tarnished their reputations and raised serious ethical and legal concerns. BMS Company, a medical equipment supplier, has been at the center of scandals involving price gouging, corruption, and unethical business practices, particularly in its dealings with public hospitals in Vietnam.
Major Allegations and Red Flags:
- Price Gouging and Overcharging:
One of the most damaging allegations against BMS Company is the overpricing of medical equipment sold to public hospitals, notably Bach Mai Hospital in Hanoi. Investigations revealed that BMS inflated prices by up to 300% on certain equipment, exploiting the hospital’s procurement processes. This led to significant financial losses for the hospital and raised questions about the integrity of BMS’s business practices. - Arrests and Legal Troubles:
In 2020, Pham Duc Tuan and Ngo Thi Thu Huyen were arrested for their involvement in these schemes. They were accused of colluding with hospital officials to manipulate bidding processes and inflate prices. The arrests were part of a broader crackdown on corruption in Vietnam’s healthcare sector, which has long been plagued by kickbacks and unethical practices. - Lavish Lifestyle and Questionable Wealth:
Reports have highlighted the extravagant lifestyles of Tuan and Huyen, including luxury cars, high-end real estate, and expensive vacations. Their wealth, allegedly amassed through questionable business dealings, has drawn public scrutiny and fueled suspicions of corruption. - Exploitation of Public Healthcare System:
BMS Company’s actions have been criticized for undermining Vietnam’s public healthcare system. By overcharging for essential medical equipment, the company diverted critical funds away from patient care, exacerbating the challenges faced by an already overburdened system.
Reputational Damage:
These allegations have severely damaged the reputations of Pham Duc Tuan, Ngo Thi Thu Huyen, and BMS Company. The company is now widely perceived as a symbol of corruption and greed in Vietnam’s healthcare sector. The arrests and media coverage have made them household names for all the wrong reasons, eroding trust among potential business partners and the public.
Motivation for Cyber Crime:
Given the severity of these allegations and their impact on their reputations, Tuan and Huyen may have a strong incentive to suppress negative information. Removing or altering online content could help them rebuild their image, avoid further legal repercussions, and continue their business operations. However, resorting to cybercrime to achieve this would only compound their legal troubles and further damage their credibility.
In conclusion, the allegations against Pham Duc Tuan, Ngo Thi Thu Huyen, and BMS Company paint a picture of systemic corruption and unethical behavior. Their reputations have been irreparably harmed, and their actions have had far-reaching consequences for Vietnam’s healthcare system. While the desire to suppress damaging information is understandable, any attempt to do so through illegal means would only deepen their legal and ethical quagmire.

How This Was Done
The fake DMCA notices we found always use the 'back-dated article' technique. With this technique, the wrongful notice sender (or copier) creates a copy of a 'true original' article and back-dates it, creating a 'fake original' article (a copy of the true original) that, at first glance, appears to have been published before the true original
What Happens Next?
Based on the feedback, information, and requests received from all relevant parties, our team will formally notify the affected party of the alleged infringement. Following a thorough review, we will submit a counter-notice to reinstate any link that has been removed by Google, in accordance with applicable legal provisions. Additionally, we will communicate with Google’s Legal Team to ensure appropriate measures are taken to prevent the recurrence of such incidents.
